All services provided by Simply Creative Design Solutions are subject to the following Terms of Service. Before purchasing or engaging in any activity with Simply Creative Design Solutions, please read and review our Terms of Service. We reserve the right to change, modify, or otherwise revise these terms without prior notice. From this point forward, we/us – the company – will be referred to {Simply Creative Design Solutions} and you – the client – will be referred to as {Client}. {Design} refers to the project/services you purchase.
Current Hourly Rate
{Simply Creative Design Solutions} current hourly rate is: $50.00 per hour.
This rate applies to ALL hourly projects, support tickets, and any other hourly services listed.
Custom Quotes
Custom Quotes provided by {Simply Creative Design Solutions} to the {Client} will be honored for 30 days. Once expired, a new Custom Quote will then be provided to the {Client} upon request. Custom Quotes must be approved by the {Client} before the Deposit & Remaining Balance Invoices are sent .
Authorization
By purchasing {Design} from {Simply Creative Design Solutions} the {Client} authorizes {Simply Creative Design Solutions} to begin work on the said purchased {Design} under the conditions agreed upon by {Simply Creative Design Solutions} and the {Client}. The {Client} authorizes {Simply Creative Design Solutions} to access any hosting or domain account for the sole purpose of installing and updating the {Design}. For hosting or domain accounts acquired prior to the agreement made between {Simply Creative Design Solutions} and the {Client}, the {Client} agrees to provide {Simply Creative Design Solutions} the necessary login credentials to install and update the {Design}. {Simply Creative Design Solutions} will retain these login credentials for the duration of the {Design} Process. Once the {Design} is completed and the agreement between the {Client} and {Simply Creative Design Solutions} is fulfilled, the login credentials will be destroyed by {Simply Creative Design Solutions} and will no longer be on record with {Simply Creative Design Solutions}.
Copyright & Licenses
1.) Copyright to the final design produced by {Simply Creative Design Solutions} is owned by {Simply Creative Design Solutions}. Under no circumstances shall a site be duplicated, sold, or redistributed. The {Client} may not alter or reuse the HTML and/or CSS coding (Site Design) that is produced by {Simply Creative Design Solutions} without the direct written consent of {Simply Creative Design Solutions}. The Credit Link must remain intact and visible on the site.
2.) Any elements including, but not limited to; text, graphics, photos, designs, trademarks, or other artwork, provided to {Simply Creative Design Solutions} by the {Client} for use in the {Design} must be owned by the {Client}. Elements provided to {Simply Creative Design Solutions} that are not owned by the {Client} must be guaranteed to be released for use in the {Client’s} {Design} by {Simply Creative Design Solutions} from the rightful owner. The {Client} understands that {Simply Creative Design Solutions} will under no circumstance, be held liable for elements provided by the {Client} that result in suit or claim of infringement for the use of these elements. The {Client} will be responsible for any and all legal fees acquired from any said accusations.
Correspondence
All correspondence between the {Client} and {Simply Creative Design Solutions} will take place primarily through email. All correspondence made through telephone, must be scheduled by the {Client} and confirmed by {Simply Creative Design Solutions} via email. Due to time constraints, No unscheduled telephone calls will be accepted. {Simply Creative Design Solutions} responds to correspondence within 72 hours once the request in submitted by the {Client}.
Disclosure
{Simply Creative Design Solutions} occasionally participates in affiliate programs where we receive a small commission from purchases made with recommended third party vendors via links located on our site. Any and all affiliate links displayed are reputable vendors that {Simply Creative Design Solutions} personally utilizes and recommends.
Payments & Deposits
{Simply Creative Design Solutions} accepts payments through PayPal only. A non-refundable $150 Deposit is required to secure the {Design} Start Date. The remaining {Design} Project Total must be paid in full within 24 hours of the {Design} Start Date. For {Design} purchases that are billed hourly, the {Client} will be required to pay the total invoice in full before the website is released back to the client. The website and said revisions will remain the temporary property of {Simply Creative Design Solutions} until the invoice is paid.
Cancellations & Refunds
Under no circumstances does {Simply Creative Design Solutions} issue refunds. If the {Client} must cancel a {Design} that is paid in full, {Simply Creative Design Solutions} will offer the {Client} a future Start Date in an effort to meet the {Client} needs. No refunds will be issued.
Support
We wish that we could provide unlimited free support to all of our clients but we simply do not have enough time in the day to accommodate this. {Simply Creative Design Solutions} includes support for a new {Design} for 3 days after the {Design} has been completed and released to the {Client}. It is the responsibility of the {Client} to thoroughly research their new {Design} to ensure there are no additional questions or issues. Any findings must be submitted by the {Client} to {Simply Creative Design Solutions} via email within the 3 day support period. Any submissions by the {Client} to {Simply Creative Design Solutions} after this time frame will be billed at the current hourly rate.
Indemnification
The {Client} agrees that the {Client} is solely responsible for complying with such laws, taxes and tariffs, and will hold harmless, protect, and defend {Simply Creative Design Solutions} from any claim, suit, penalty, tax or tariff arising from the {Clients}’s exercise of Internet electronic commerce.
